Terms & Conditions of Service
Disclosure, Assumption of Risk and Waiver of Liability

In this agreement, Program means the classes, workshop, yoga and movement practices, breathing practices, relaxation, meditation, online modules, educational content, partner-support demonstrations, hands-on techniques, printed resources, community participation and any related services provided by Mother’z Yoga.

1. I understand that participation in the Program involves physical activity and may include yoga postures, stretching, breathing techniques, relaxation practices, partner-assisted techniques, and education relating to pregnancy, labour, birth and post-birth recovery.

2. I acknowledge that physical activity carries inherent risks, including but not limited to muscle soreness, strain, dizziness, aggravation of an existing injury or condition, slips, falls, and other physical or mental discomforts. 

3. I confirm that I have consulted, or have had the opportunity to consult, my doctor, midwife or other qualified healthcare practitioner before participating, and that I will not participate in any activity that I have been advised to avoid.

4. I confirm that I'm physically able to participate, and that I will inform Mother’z Yoga of any injury, illness, pregnancy complication, medical condition, surgery, pain, limitation or other circumstance that may affect my participation. I also agree to promptly inform Mother’z Yoga if anything changes.

5. I understand that all information provided in the Program is general educational information only and is not medical, midwifery, physiotherapy, psychological or other health advice, diagnosis or treatment. I agree to seek advice from my healthcare practitioner regarding my own circumstances and to not rely on the Program as a substitute for medical care.

6. I agree to participate within my own limits, to modify or stop any practice if I feel pain, discomfort, dizziness, bleeding, shortness of breath, contractions, reduced fetal movement, or any unusual symptom, and to seek medical advice where appropriate.

7. I agree to never share the username/password with anyone not authorised by Mother'z Yoga. If Mother'z Yoga suspects the misuse of our learning platform, we have the right to revoke your program access.

8. I voluntarily assume all ordinary risks arising from my participation in the Program.

9. To the fullest extent permitted by law, I release and hold harmless Mother’z Yoga, Ragini, its officers, employees, contractors, facilitators, venue providers and agents from liability for loss, damage, injury or expense arising out of or connected with my participation in the Program, except where liability cannot lawfully be excluded.

10. Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law. Without limitation, this waiver does not apply to liability arising from reckless conduct or any other liability that cannot legally be excluded.

11. I understand that Mother’z Yoga may refuse or stop my participation if it reasonably believes participation is unsafe for me, my baby, my partner, other participants or staff.

12. Member Account, Password and Security

    You agree to: (a) provide true, accurate, current and complete information about yourself in any of our opt-in or signup forms and (b) maintain and promptly update your Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, MYW reserves the right to suspend and refuse the use of the Service at any time.

13. While creating an account, you will be required to choose a password and user name. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. 

14. MYW also reserves the right to cancel any membership it believes has been compromised, or is being used fraudulently, at its own discretion.

15. We reserve the right to modify, suspend or discontinue, whether temporarily or permanently, the Sites (or any part thereof) or Products, for any reason and without notice.

16.  You agree that all content on our website, is owned or licensed by us.  You must only use the website and its content “as is” for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of MYW. 

17. I confirm that the information I provide to Mother’z Yoga is true and complete to the best of my knowledge.
